You are purchasing a digital collectible in the form of an ERC-1155 non-fungible token (the "Pioneer Pass" or "NFT") issued by Melcher Studios ("we", "us", "Melcher") on the Base blockchain (chain ID 8453). The NFT is delivered to the Ethereum-compatible wallet address you provide at checkout.
There are three tiers:
Supply caps are enforced by the smart contract and cannot be exceeded.
If a payment is captured but a mint fails for a technical reason on our side and we are unable to deliver the NFT within seven (7) days, we will refund the original PayPal payment in full upon request. This is the only refund scenario.
Initiating a chargeback or payment dispute against us after a successful mint may result in legal action to recover the cost of the NFT plus reasonable fees.
You are solely responsible for providing a correct, accessible, and secure EVM-compatible wallet address at checkout. We will mint the NFT to whatever address you provide. If you provide an incorrect or inaccessible address, the NFT will be delivered to that address and cannot be moved or recovered by us.
We strongly recommend using a wallet you control, such as Coinbase Wallet, Rainbow, MetaMask, or a hardware wallet. Do not provide an exchange deposit address unless you are certain the exchange supports ERC-1155 NFTs on the Base network — most do not.
The Pioneer Pass is sold as a digital collectible. It is not:
You should not purchase a Pioneer Pass with the expectation that it will increase in value or generate returns.
Any perks, access rights, or utility associated with the Pioneer Pass are described on the Pioneer Pass sales page as of the date of your purchase. We reserve the right to add new perks but make no guarantee that any specific perk will be maintained indefinitely. Where a perk requires our continued operation (for example, access to a hosted VR Hub product), the perk persists only for so long as we operate that product.
Unless expressly reassigned by Melcher Studios in writing, off-platform community perks, support benefits, credits, and calls remain tied to the original verified purchaser even if the NFT is transferred to a new wallet.
Each Pioneer Pass tier includes a personal, non-transferable price-lock on the holder's VR Hub subscription rate, subject to the conditions below:
The price-lock period begins on the date your first paid VR Hub subscription is activated and runs for the number of consecutive years specified above. If you allow your subscription to lapse for more than ninety (90) days, the price-lock terminates and cannot be reinstated. The price-lock applies to your personal subscription login only; bundle purchases under Section 7 use the bundle pricing in effect at the time of each bundle order.
The price-lock is tied to the original verified purchaser's email and is not transferable with the NFT. Transferring or selling the Pioneer Pass NFT does not transfer the price-lock to the new wallet holder.
The CAD $3,500/year founder rate, the rate-rise reference of approximately CAD $5,000, and the Pioneer Pass tier prices listed in Section 1 are stated in their respective currencies (USD for the NFT, CAD for VR Hub subscriptions). We reserve the right to adjust the public VR Hub subscription price at any time; the founder price-lock protects the holder from those increases for the duration specified above.
VR Hub offers volume discounts on annual subscription logins. Each login includes unlimited sessions across the full VR Hub module library for the duration of the paid annual term, subject to fair-use limits set out in the platform documentation. Bundle pricing is open to all customers and stacks multiplicatively with the Pioneer Pass-holder bonus described below. Pricing in effect as of the date of these Terms:
Pioneer Pass holders receive an additional 10% discount that stacks on top of the volume discount above. Pass-holder pricing is verified against the original purchaser's email and, where applicable, the wallet address holding the NFT at the time of the bundle order.
Bundles are sold for one (1) annual subscription term. Renewals are not automatic for the launch period; we will contact you before your subscription anniversary with a renewal invoice. Bundle pricing at renewal will be whatever bundle pricing is then in effect; the founder price-lock under Section 6 only applies to the Pioneer Pass holder's personal login, not to additional bundle logins.
Refunds for bundle subscriptions are governed by Section 2 of these Terms. Unused logins within a paid bundle term cannot be returned for a refund but may be reassigned within your organization at no charge.
Subject to your compliance with these Terms, Melcher Studios grants you a worldwide, non-exclusive, royalty-free license to display the artwork associated with the Pioneer Pass NFT you own for personal, non-commercial use, including on social media and in personal collections. You may not use the artwork to imply endorsement by Melcher Studios, to mint derivative NFTs, or for commercial merchandise without prior written permission.
Buying NFTs involves substantial risk. By purchasing, you acknowledge and accept that:
You must be at least the age of majority in your jurisdiction (18 in most Canadian provinces and US states; 19 in some) to purchase a Pioneer Pass. By purchasing, you represent that you are not on any sanctions list and that purchasing is lawful in your jurisdiction.
Prices are listed in US dollars and do not include any taxes that may apply in your jurisdiction. You are solely responsible for determining and paying any sales, use, value-added, goods-and-services, or income taxes arising from your purchase, ownership, or disposition of the NFT.
We collect your email address and wallet address to process your order and deliver the NFT. We may use your email to send you a purchase confirmation and important updates about the Pioneer Pass. We will not sell your email or wallet address to third parties. See our Privacy Policy for full details.
To the maximum extent permitted by law, Melcher Studios' total liability arising out of or related to your purchase shall not exceed the amount you paid for the NFT. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill.
These Terms are governed by the laws of the Province of Saskatchewan, Canada, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your purchase shall be resolved exclusively in the courts of Saskatchewan, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. The version in effect at the time of your purchase governs that purchase. We will not retroactively apply new terms to past purchases in a way that materially reduces your rights.
